It is considered unethical for a CPA to create operating agreements and form entities on the behalf of clients unless that CPA is also an attorney.
While some CPAs will provide such a service to clients, it’s not recommended to engage CPAs in such a service as an attorney will be better suited to protect your assets from liability.
Even though a CPA shouldn’t set up an entity for a client, they are not precluded from advising on an entity structure from a tax perspective.
